Meeting Minutes – September 4, 2018
FINAL Dated; 9.6.2018
Location:  Fire Station, 9339 SE Causey 
Board Members Present:  Neil Gavrich, Suzanne Merritt, John Chapman, James Allen, Nancy Hall, Jonathan Handsaker, Steve Schroeder and Natalie Harbaugh.
Board Members Absent: Josh Gavrich
Homeowners Present:  Carl Feague and Khristina Powell. Thank you for attending!
Guests:  None.
Call to Order:   7:10pm by President Neil Gavrich.
Approval of Meeting Minutes – Board Meeting July 10th 2018
The Board members had the draft minutes available by email. A motion was made by Neil Gavrich to approve the July 10th meeting minutes, seconded by Suzanne and all board members present approved.
Homeowner Concerns;
  • The board has received two complaints and follow up complaints by email in regard to the Airbnb event on 8.13/14.18 on Cleone Court.
  • Pamela Cunningham sent an email on 8.26.18 asking to install a tiny library in front of her home. Neil replied and said he would forward the information to the rest of the board. All board members agreed the library would be great as long as it's maintained, neat, etc. Pamela was going to send plans to Neil.  
BOARD OFFICERS/COMMITTEE REPORTS
President: Neil Gavrich
Agenda;
  • Approval of the July 10th minutes.
  • National Night out block party was successful around 100 folks came. Raised $78.00 for the K9 unit. Neil, Josh, Jonathan, Steve, Natalie and their Spouses, spent a lot of time and a great deal of work putting the event together.
  • Home owner concerns;
  • Airbnb, Little Library, extra trees planted in the greenspace finger off Stevens road without board approval.
  • Board Member, committee reports.
  • Vice President Election. 
Vice-president: Suzanne Merritt
  • Is moving out of the area and has Resigned effective after this meeting. Suzanne counted the votes for the new VP then stayed after the meeting and to give the Khristina an overview. Thank you for all your work Suzanne!
Treasurer’s Report: John Chapman
  • John noted 11-12% of homeowners are late on payment of dues. John also noted that per our covenants Article 4.1 (3) no lot shall be used except for residential purposes. A resident is a person who lives somewhere permanently or on a long term basis. A residential purpose is a purpose involving residents and AirBnb and like kind customers are, by definition, are not residents. John motioned that all rentals under a month are not allowed and the Airbnb on Cleone Court is in violation of the Covenants. James seconded the motion and all other board members present approved. The board decided the owners on 10030 SE Cleone Court will be sent a letter by the end of the week to cease these operations by the 10th of October or will be fined the maximum amount penalty per day and that any covenant violations in the interim would be subject to the same.     
Secretary; James Allen
  • James contacted Clackamas County as stated in the last minutes. And per the code any fowl, etc., needs to be located no closer than 100 feet from any dwelling other than the dwelling of the owner of the subject property. See #821. F. 1 & 2. It appears the adjacent owners need to do their due diligence to see if that 100 feet is within those guidelines.
  • James also formally complained the Airbnb continues to be a issue and is in violation of the covenants. As the board approved action, James will be sending the board letter certified mail to the property owners. Also noted past meeting concerns such as the HOA walkways.
Environmental Committee: Natalie Harbaugh
  • Natalie noted she received a call from the gentleman that planted the firs in the HOA common areas. After discussion, Natalie and John are planning to visit the site this coming Sunday and mark the trees that may stay. In the next few months the others will be removed. Natalie also mentioned talking with the neighbor about the tree that continues to get complaints.
Covenant Compliance: Jonathan Handsaker
  • Noted very few homeowners respond to letters. Hasn't received any complaints recently.
Architectural: Josh Gavrich
  • Josh has had a few homeowners email him and has approved requests and is waiting for others to provide further information.
Safety:  Steve Schroeder
  • Steve said the school received a grant for safer routes on Stevens road. Steve's walked through the HOA and noted several walkways in need of repair.
Eagle Landing/CPO:  Nancy Hall
  • The Sunnyside and West Mt. Scott CPOs officially were merged together as of July 17, 2018. The next (first joint meeting) CPO meeting is on October 1st at the Fire Station - 7:00PM. There will be a hearing at the Happy Valley Planning Commission on October 9th regarding Eagle Landing. They are seeking a major amendment to their preliminary master plan. If approved by the Planning Commission, the next hearing will be before the Happy Valley City Council on November 6th. Usually the meetings are at 7:00PM.   
HOA Web Site and Homeowner Participant: Thomas Spathas manages the site.

Adjournment: at 8:57pm by Neil Gavrich.
Next Regular Board Meetings:  October, 2018 at 7 pm at the Fire Station and each first Tuesday of the month that follows, except in August and December when there will be no meeting.
